TAPA RESOLUTION 11 DUES CHECKOFF PROGRAM

WHEREAS the 21 Air, LLC. pilots (herein, Pilots) are organized by the 21 Air Pilot’s Association, Inc. (TAPA, Inc.) under a Collective Bargaining Agreement (CBA) and a Constitution & Bylaws (Bylaws) with Resolution #9 approved and amended by TAPA’s Board of Pilot Representatives (BPR) on Aug. 3, 2022.

WHEREAS the Company collects dues by the CBA from the Section #19 Dues Check-Off (DCO) program but will not transferred these collected dues to TAPA nor report to TAPA the accounting of these funds; impacting TAPA’s ability to function and represent 21 Air pilot’s interests under Title II of the Railway Labor Act (RLA).

WHEREAS the State of Florida Secretary of State’s (SOS) office requires non-profit Corporations such as the 21 Air Pilot’s Association (TAPA) to register under Florida Statute s.617.0202 and s.617.0501 and the Internal Revenue Service (IRS) requires each IRS 501(c)(5) intended non-profit to disclose record keeping for US federal tax filing purposes.

THEREFORE, BE IT RESOLVED, that TAPA’s membership directs the Company to release the collected pilot dues and financial records within two (2) business days of deducting funds from 21 Air pilot pay checks so TAPA is able to pay its consultants and operating expenses.

THEREFORE, BE IT FURTHER RESOLVED, that TAPA, Inc. shall direct the TAPA President to recommend OSHA’s optional Alternate Dispute Resolution (ADR) be chosen or seek other legal action, rather than default to the FAA investigation of 21 Air, LLC., and that all pilot dues awarded from OSHA’s “ADR” or by other legal means, shall be returned to the TAPA treasury upon settlement with the Company.

THEREFORE, BE IT FURTHER RESOLVED, within five business (5) days, the TAPA Board shall review the dues rate set from Resolution #7 and Article II, Sec. 3 of the Bylaws and issue a report to the TAPA pilots with the Board of Pilot Representative’s recommendations for TAPA’s 2022-23 yearly operating budget.
